Who has to see a SAP?

Any DOT-regulated employee who has a verified positive drug test, an alcohol test of 0.04 or higher, or a refusal to test must complete the SAP process before returning to any safety-sensitive function.

Can my employer pick the SAP for me?

No. Under 49 CFR Part 40, the employer must provide a list of qualified SAPs, but you choose which one to use.

Do I need to be sober or in treatment before I call?

No. The evaluation is the first step, and it is where the recommendation is made. Call as soon as you learn of the violation.

Can the evaluation be done via telehealth?

Yes, in most cases. DOT allows qualified SAPs to conduct evaluations by real-time two-way video where allowed by state law. Bailey's provides secure telehealth to drivers in North Carolina and South Carolina.

How long is my record in the Clearinghouse?

The violation remains in the FMCSA Drug & Alcohol Clearinghouse for five years, or until you complete the return-to-duty process — whichever is later. Status changes from "prohibited" to "not prohibited" once you finish and pass the RTD test.

Do I have to pay out of pocket?

Yes. SAP services are not billable to health insurance under DOT rules. Fees vary by provider — ask up front for a full fee schedule so there are no surprises.

What if I use a non-DOT counselor?

The evaluation will not count. Only a DOT-qualified SAP can perform the initial evaluation, recommend the program, and complete the follow-up evaluation.

What happens if I fail a follow-up test?

A positive follow-up test is treated as a new violation. You are removed from safety-sensitive duty and start the SAP process from the beginning.

Can I drive for a non-DOT employer during the process?

You cannot perform any DOT safety-sensitive function until you complete the RTD test. Non-DOT work is a separate question — check with the employer and any state requirements.

How do I switch SAPs mid-process?

You can, but the new SAP typically must re-evaluate you. To avoid duplicated work and cost, only switch if there is a real reason.
