What to do after a DOT violation
A CDL violation isn't the end of your career. Here's exactly what to expect, how long it typically takes, and what it costs — so you can plan a real path back to work.
Typical timeline
Most drivers complete the entire RTD process in 30 – 90 days, depending on the recommended plan and testing scheduling.
What it costs
Evaluation fees are quoted transparently up front. Treatment and testing are additional and depend on the recommended plan.
Documents to bring
A short checklist ensures your evaluation moves quickly and your employer receives what they need on time.
Your return-to-duty journey
- Step 1
You had a positive test or refusal.
Your employer must immediately remove you from safety-sensitive duty and provide a list of qualified SAPs. FMCSA reports the violation to the Clearinghouse.
- Step 2
You choose a SAP and complete an initial evaluation.
The SAP evaluates your history and recommends an education or treatment plan appropriate to your situation.
- Step 3
You complete the plan.
Once the recommended education or treatment is completed, you're ready for the follow-up evaluation.
- Step 4
Follow-up evaluation and RTD report.
The SAP issues a follow-up report to your employer confirming compliance and outlining your follow-up testing plan.
- Step 5
Return-to-Duty test and back on the road.
Your employer schedules an observed RTD test. A negative result plus a compliant SAP report puts you back to work.
Documents to bring
- Government-issued photo ID and CDL
- Copy of the positive test result or refusal notice
- Your employer's name, DOT agency, and DER contact
- Any prior SAP reports or treatment records
- Insurance card, if using coverage for any recommended treatment

Who pays?
DOT rules generally leave payment to the driver, though some employers or EAPs contribute. We're transparent about fees.
What if I'm an owner operator?
You still need a Qualified SAP. We work with your consortium/TPA to keep everything compliant.
