What is a DOT SAP evaluation?
A DOT SAP evaluation is a clinical assessment (conducted virtually by secure telehealth) performed by a qualified Substance Abuse Professional as required by U.S. Department of Transportation regulation 49 CFR Part 40. It is the mandatory starting point of the DOT Return-to-Duty (RTD) process for any safety-sensitive employee who has violated a DOT drug or alcohol testing rule.
The SAP's job is not to punish. It is to make a clinical recommendation for the education and/or treatment the driver needs before they can safely return to a safety-sensitive role — and to confirm the driver has completed that plan.
Who is required to complete one?
A SAP evaluation is required for any safety-sensitive employee regulated by a DOT agency who:
- Tested positive on a DOT drug test
- Tested at 0.04 or higher on a DOT alcohol test
- Refused a required DOT drug or alcohol test (including a shy bladder or shy lung without a valid medical explanation, adulterated or substituted specimens, or failing to appear)
This covers CDL drivers (FMCSA), pilots and flight crew (FAA), transit workers (FTA), rail employees (FRA), pipeline workers (PHMSA), and Coast Guard personnel (USCG).
The five stages of the SAP process
- Initial evaluation (virtual telehealth). The SAP conducts a clinical assessment and, based on that assessment, recommends a specific course of education, treatment, or both.
- Education or treatment. The driver completes the SAP's recommendation with a qualified provider. The SAP does not pick the provider for you, but will give you referral options.
- Follow-up evaluation (virtual telehealth). The SAP verifies successful compliance with the recommended plan and determines whether the driver is eligible to return to duty.
- Return-to-Duty (RTD) test. The employer arranges a directly-observed RTD drug and/or alcohol test. A negative result is required before the driver may perform any safety-sensitive function.
- Follow-up testing plan. The SAP prescribes a follow-up testing schedule of at least six unannounced tests in the first 12 months, and may extend up to 60 months.
How long does the SAP process take?
The timeline depends on the treatment recommendation and how quickly the driver completes it. In most cases:
- Initial evaluation: can usually be scheduled within a few days.
- Education or treatment: a few weeks to several months.
- Follow-up evaluation, RTD test, and follow-up plan: typically within a week once treatment is complete.
What the SAP does not do
A SAP is not an advocate for the driver or the employer. The SAP will not:
- Restore your CDL or clear you in the FMCSA Clearinghouse (that is the driver's responsibility after a negative RTD test)
- Guarantee re-hire — that is always the employer's decision
- Change or shorten a treatment recommendation to speed up the process
Confidentiality and reporting
SAP records are handled in accordance with HIPAA and 49 CFR Part 40. Reports go to the designated employer representative (DER) and, where applicable, to any future DOT-regulated employer that requests them during a pre-employment query in the Clearinghouse.
