The first 24 hours
Under 49 CFR Part 40, a verified positive test, a refusal, or an alcohol test of 0.04 or higher means your employer must immediately remove you from any safety-sensitive function. That includes driving a commercial motor vehicle, operating heavy equipment, or performing any other duty covered under DOT regulations.
Your employer is also required to give you written information about SAPs qualified to evaluate you. You choose the SAP — the employer cannot pick one for you or require you to use their preferred provider.
Clearinghouse reporting (CDL drivers)
For CDL drivers, the violation is reported to the FMCSA Drug & Alcohol Clearinghouse within three business days. It stays on your record as "prohibited" until you complete the return-to-duty process. Any current or prospective employer running a Clearinghouse query will see it.
Your rights
- You have the right to request a split-specimen test within 72 hours of learning of a positive result.
- You have the right to choose your own qualified SAP.
- Your evaluation and treatment records are confidential and only released to authorized parties.
- The SAP is not there to judge you — their role is clinical, educational, and focused on safe return to duty.
Starting the SAP process
The sooner you begin, the sooner you can return to work. The first step is a face-to-face SAP evaluation (by secure telehealth (virtual only) where allowed). Your SAP will:
- Complete a full clinical assessment of your substance use and history.
- Recommend an appropriate education program, treatment program, or both.
- Send the recommendation to your Designated Employer Representative (DER).
- Re-evaluate you after you finish the program to confirm compliance.
- Set your follow-up testing plan, which lasts at least 12 months and up to 5 years.
Common mistakes to avoid
- Waiting. The Clearinghouse status doesn't change until the process is complete.
- Using an unqualified counselor. Only a DOT-qualified SAP can sign off.
- Skipping the return-to-duty test. It must be observed and negative before you can perform any safety-sensitive function.
- Missing follow-up tests. Missed tests are treated as refusals and restart the process.
