What it is

An immigration psychological evaluation is a clinical interview and written report completed by a licensed mental health professional. It documents the psychological history, current mental health, and — where relevant — the anticipated impact of separation, return to the country of origin, or ongoing legal proceedings.

Who requests them

Immigration attorneys most often request evaluations to support their client's case. Clients can also seek an evaluation directly if they are preparing a case or working with an attorney who has not yet requested one.

Why they matter

A well-written evaluation gives officers and judges concrete, clinical detail beyond what any single interview can capture. It humanizes the case and grounds it in evidence — trauma symptoms, functioning, and treatment needs — rather than argument.

What the report typically covers

  • Identifying information and reason for referral.
  • Relevant personal, medical, and immigration history.
  • Clinical interview findings.
  • Results of validated screening tools.
  • Diagnostic impressions, if applicable.
  • Discussion of the specific legal question (e.g., hardship, credible fear, impact of trauma).
  • Recommendations for care.

What it is not

  • It is not a legal opinion — that belongs to your attorney.
  • It is not a promise of a specific immigration outcome.
  • It is not therapy — though clinical referrals may be included.

How long it takes

Most evaluations involve one or two appointments totaling two to four hours, followed by a written report typically completed within one to two weeks.

Confidentiality

The report is written for the specific legal purpose you consent to, and shared only with the parties you authorize — usually your attorney and, through them, the relevant immigration authority.
